The long-awaited Digital Markets, Competition and Consumers Bill (Bill) has now been laid before Parliament. This new legislation, when enacted, represents the most significant reform of competition and consumer protection law in the UK in recent years. It will implement policy proposals which have been in the making for several years.

New UK Block Exemption Orders come into force for R&D and Specialisation Agreements

On 1 January 2023, the Competition Act 1998 (Research and Development Agreements Block Exemption) Order 2022 (R&D BEO) and the Competition Act (Specialisation Agreements Block Exemption) Order 2022 (Specialisation Agreements BEO) came into force in the UK, replacing the retained EU regulations which expired on 31 December 2022.

General Court on 'Thin Ice'​ with its ISU Ruling, says Advocate General

In an opinion issued this morning, Advocate General Rantos has proposed that the European Court of Justice should set aside the 2020 judgment of the General Court (which rejected in large part the International Skating Union’s appeal against the EU Commission’s 2017 infringement decision on its treatment of third-party organised speed skating events) and refer the case back the General Court for reconsideration.

European Court clarifies 'rules of the road'​ (or rails) in litigating abuse of dominance claims in regulated sectors

Background

The request to the ECJ for a preliminary ruling in this case concerned the interpretation of Article 102 TFEU and provisions of Directive 2001/14/EC (the Directive) on the allocation of railway infrastructure capacity and the levying of charges for the use of railway infrastructure.
