Global Switch Estates 1 Ltd (“GSEL”) engaged Sudlows Ltd (“Sudlows”) for various works at GSEL’s specialist data centre located at East India Dock House in London. Four adjudications were raised between the parties following disputes regarding various matters.
FK Construction Limited (“FK”) was sub-contractor to ISG Retail Limited (“ISG”) for works involving roofing and cladding in relation to ISG’s Project Barberry. FK issued an application for payment of £1,691,679.94. ISG failed to issue a payment notice, submitting a pay less notice instead. The sum sought by FK was not paid, and FK referred the dispute to adjudication.

J A Ball Limited (“JAB”) was a sub-contractor appointed by St Philips Homes (Courthaulds) Ltd (“SPC”) for works involving the conversion of a commercial property into residential apartments. The contract was a JCT contract with bespoke amendments. JAB entered administration and did not complete the works. SPC completed the works, which JAB considered an unlawful termination of the contract. JAB sought payment of the remainder of the contract value from SPC.

Cooper Construction contracted with LJR Interiors to perform dry lining, plastering and screed works at a development property in Oxfordshire. The parties did not adopt a standard form contract, and instead reached agreement through letter and purchase order on 26 August 2014. The agreement did not include an adjudication clause, so the Scheme for Construction Contracts applied by virtue of the Housing Grants, Construction and Regeneration Act 1996.
Kings College London (KCL) and the Adjudication Society (AS) have recently prepared a report with the objective of publishing robust and comprehensive data in relation to construction adjudication, so that established trends can be reviewed, and the overall success of construction adjudication in the UK can be improved. 10 Adjudicator Nominating Bodies (ANB) and 257 individuals involved in adjudication took part in the survey. There are both expected and unexpected results.
