Broadening the parameters of AI patentability

On 21 November 2023, the UK High Court handed down its judgement in Emotional Perception AI Ltd v Comptroller-General of Patents, Designs, and Trade Marks, which considered the application of the computer programs exclusion to the patentability of an AI invention.

Can an AI be the Inventor of a Patent? The UK Supreme Court Unanimously Rejects AI Inventorship

As courts around the world grapple with what the rapid growth of artificial intelligence ("AI") means for intellectual property rights, the UK Supreme Court has handed down a judgment which addresses the issue of whether AI can be the inventor of a patent. The judgment is unambiguous in firmly rejecting the notion, as it relates to current legislation.

Artificial Intelligence (AI) – Guidance for Judicial Office Holders

New Guidance was published on 12 December 2023 by the Courts and Tribunals Judiciary service: Artificial Intelligence (AI) – Guidance for Judicial Office Holders. It’s intended to assist and instruct judges on their use of AI.

The purpose of this guidance is to highlight the risk of difficulties arising and to temper reliance by the judiciary upon AI in the work that they and their staff undertake. It suggests ways to avoid unreliable and potentially fundamentally flawed judgments.

“Willie’s Law” – testing times for capacity in Scotland?

Before William Johnston died, he signed a Partnership Variation Agreement. However, his family claimed that he did not have capacity to sign it and are calling for an introduction of “Willie’s Law”. The law would require a medical professional to co-sign legal documents of vulnerable people to prove they had legal capacity.

Easy Life v easyGroup trademark dispute

The dispute

British indie music group Easy Life, formed in 2017, have not been finding life so smooth with the news that easyGroup Ltd, owners of the easyJet brand name, have started legal proceedings against them. The band appears to have flown under the easy radar until about 2020, when they began promoting their “Life’s a beach tour” with the poster below.

Logan v Irons: the doctrine of confusion and knowing your servitude rights

This matter, brought before the Sheriff Appeal Court (“SAC”), involved a dispute between neighbouring property owners in Dunbog, Fife. Stuart Logan owned the property known as ‘The Auld Kirk’ and sought a declarator that his property benefitted from servitudes of aqueduct (the right to convey water across the land) and access over the neighbouring property of ‘Beauty’s Land’, which was owned by Andrew Irons.

Moveable transactions – Scotland v England: Round 1 – assigning receivables

  • Restrictions on assigning, which are onerous for invoice financing, still work in Scotland unlike in England.
  • There are still more post-insolvency assets in Scotland than England for insolvency practitioners as the Moveable Transactions (Scotland) Act 2023 contains restrictions on assigning rights following an assignor’s insolvency.
